ShelfScout Terms of Use

About these terms

These terms govern your use of ShelfScout, a service for comparing supermarket prices in New Zealand. By using ShelfScout, you agree to these terms. If you do not agree, please do not use the service.

You can browse prices without an account. If you create an account, you must be at least 13 years old and able to agree to these terms.

What ShelfScout provides

ShelfScout collects and organises supermarket catalogue information so you can search products, compare prices between selected stores, build shopping lists, and create price watches. ShelfScout is an independent comparison service. It is not a supermarket, does not sell groceries, and is not an agent or partner of the supermarkets it compares.

Prices, products, and availability

Prices and product information come from retailers' online catalogues and are refreshed periodically. Although we work to keep the information useful and accurate, a retailer may change its prices, promotions, product details, or stock before ShelfScout updates. In-store prices may also differ from online prices.

List totals and savings are estimates. They may not include such things as loyalty pricing, multibuy conditions, substitutions, minimum quantities, delivery fees, service fees, deposits, or products that are unavailable when you shop. Check the retailer's current price and conditions before making a purchase.

Any purchase is made directly from the relevant retailer and is governed by that retailer's terms. ShelfScout is not responsible for fulfilling, refunding, or resolving a grocery purchase.

Your account

  • Provide accurate information when creating an account.
  • Keep your sign-in details secure and tell us promptly if you believe somebody else has accessed your account.
  • You are responsible for activity carried out through your account unless it results from something ShelfScout is responsible for.
  • You may request account deletion from the app or at www.shelfscout.nz/delete-account.

If you sign in through Google or another identity provider, your use of that provider remains subject to its own terms and policies.

Acceptable use

You may use ShelfScout for lawful personal and household purposes. You must not:

  • interfere with or attempt to bypass the service's security;
  • use automated tools to scrape, copy, or place unreasonable load on ShelfScout without our written permission;
  • access another person's account or use ShelfScout to break the law or infringe another person's rights; or
  • reproduce, resell, or commercially exploit ShelfScout or a substantial part of its data without our written permission.

We may restrict or suspend access where reasonably necessary to protect ShelfScout, its users, or others, or to investigate a suspected breach of these terms. Where practical, we will explain the reason and give you an opportunity to resolve the issue.

Intellectual property

ShelfScout's software, design, branding, and original content are owned by or licensed to ShelfScout. Retailer names, logos, product names, and other third-party material belong to their respective owners. Their appearance in ShelfScout does not imply sponsorship or endorsement.

Availability and changes

We may maintain, improve, change, or discontinue parts of ShelfScout. We do not promise that the service will always be available or error-free. Where a change materially reduces an account feature, we will take reasonable steps to give advance notice when practical.

Liability and your legal rights

Nothing in these terms excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded, including any rights you may have under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

To the extent permitted by law, ShelfScout is not responsible for indirect or consequential loss, or for loss caused by inaccurate retailer information, retailer conduct, your reliance on an estimated price, or events outside our reasonable control. This does not limit responsibility for loss that ShelfScout cannot lawfully exclude or that is directly caused by our breach of these terms or failure to exercise reasonable care and skill.

Privacy

Our Privacy Policy explains how ShelfScout collects, uses, stores, and shares personal information.

Ending your use of ShelfScout

You may stop using ShelfScout at any time. You can also delete your account, subject to the 30-day deletion grace period described in the Privacy Policy. Provisions that are intended to continue after your use ends, including those concerning intellectual property, liability, and disputes, will continue to apply.

Changes to these terms

We may update these terms as ShelfScout or its legal obligations change. We will post the revised terms here and update the date above. If a change materially affects your rights or how an account feature works, we will take reasonable steps to make it clear before the change takes effect. Continuing to use ShelfScout after the updated terms take effect means you accept them.

Governing law and disputes

These terms are governed by New Zealand law. Before starting formal proceedings, please contact us so we can try to resolve the issue. You may also have the right to take a dispute to the Disputes Tribunal or another appropriate body. Nothing in this section prevents either party from seeking urgent relief or using a right available under applicable law.
